1. Introduction

Welcome to ODSY. These Terms & Conditions explain the terms applicable to purchases made through our online jewellery store.

By placing an order, you agree to the terms applicable to that transaction, subject to your rights under South African law.

3. Products and Descriptions

ODSY sells jewellery and related accessories. We aim to provide accurate product descriptions, materials, measurements, images and prices.

Product colours and appearance may vary slightly due to lighting and screen settings. Any material differences or relevant product limitations will be disclosed.

Product availability is subject to stock and our ability to fulfil an order.

4. Pricing

All prices are displayed in South African rand (ZAR).

Applicable delivery charges, taxes and other fees will be disclosed before the customer confirms an order.

ODSY may update product prices from time to time. A later price change will not automatically change the price of an already accepted order.

Any pricing errors will be handled in accordance with applicable consumer law.

5. Orders and Availability

Customers can review their cart, delivery details and total charges before submitting an order.

Submitting an order is a request to purchase the selected products. The transaction becomes binding when ODSY accepts the order, subject to applicable law.

If an ordered product becomes unavailable, we will notify the customer and provide the appropriate remedy, including a refund where required by law.

Customers can access available order information through their account. Additional transaction records can be requested through our support channel.

6. Payments

ODSY uses Paystack to facilitate online payments.

Customers are redirected to or interact with Paystack's secure payment environment when completing a transaction.

An order will only be treated as paid after the payment has been successfully verified.

If payment fails or remains incomplete, the order may remain pending or be cancelled in accordance with our order-processing procedures.

Payment information is handled in accordance with our Privacy Policy and the applicable terms of the payment provider.

7. Shipping and Delivery

ODSY offers delivery within South Africa using the delivery methods available during checkout.

Available delivery options, costs, estimated processing periods and delivery times will be displayed or explained before an order is confirmed.

Delivery estimates are not guarantees. If a delay or inability to fulfil an order occurs, customers retain their rights under applicable law.

Customers must provide accurate delivery information and comply with applicable collection requirements for collection-point deliveries.

Read our Shipping & Delivery Policy

8. Cancellations, Returns and Refunds

Customers may have cancellation and cooling-off rights under the Electronic Communications and Transactions Act, including a seven-day cooling-off period for qualifying online purchases, subject to statutory exceptions.

Under the Consumer Protection Act, customers also have rights concerning goods that fail to meet applicable quality and safety standards, including the statutory implied warranty of quality.

Nothing in these Terms & Conditions limits rights or remedies that cannot lawfully be excluded.

Return procedures, refund arrangements and applicable exclusions are explained in our Returns & Refunds Policy.

9. Customer Accounts

Customers are responsible for providing accurate account information and taking reasonable steps to protect their login credentials.

Customers should notify ODSY if they suspect unauthorized access to their account.

ODSY may restrict account access where reasonably necessary to address fraud, security threats or unlawful activity, subject to applicable law.

10. Acceptable Website Use

Customers must not misuse the website, attempt unauthorized access, interfere with website security or use the website for unlawful activities.

ODSY may take reasonable steps to protect the website, customers and business systems.

11. Intellectual Property

Unless otherwise indicated, ODSY's original website content, branding, photographs and designs are owned by ODSY or used with permission.

You may not reproduce or commercially exploit protected content without authorization, except where permitted by law.

12. Website Availability and Liability

We aim to keep the website available, accurate and secure, but temporary interruptions or technical errors may occur.

To the extent permitted by applicable law, ODSY is not responsible for losses arising solely from circumstances outside its reasonable control.

Nothing in these terms excludes or restricts liability or consumer remedies where doing so would be unlawful, including under the Consumer Protection Act.

13. Privacy and Personal Information

ODSY processes customer information for purposes including account management, order fulfilment, payments, delivery and customer support.

Our Privacy Policy explains how personal information is processed and how customers can exercise their privacy rights.

14. Complaints and Disputes

Customers are encouraged to contact ODSY first so that we can investigate and attempt to resolve complaints.

Where a dispute cannot be resolved directly, customers may use applicable consumer-protection bodies, dispute-resolution processes or courts.

These terms are governed by South African law, without limiting mandatory consumer protections.

15. Changes to These Terms

ODSY may update these Terms & Conditions to reflect changes to our business, website or applicable law.

Updated terms will be published on this page. Changes will not retrospectively remove rights arising under an existing transaction.
